Training & Events

Now is an excellent time to provide training.  Bob has a number of training programs scheduled. Attached is a white paper from a recent presentation, Pregnancy, Accommodations (telecommuting and attending church), Retaliation, and Religious Discrimination Cases & EEOC Guidance (July 2015).

The following are current popular training modules:

  • Family Medical Leave Act.  Effectively manage FMLA, the medical certification process and mitigate the risks of termination when FMLA leave ends.  Hansler v. Lehigh Valley Hosp. Network, No. 14-1772, 2015 WL 3825049 (3rd Cir. June 22, 2015) is highlighted – elucidating best practices for handling an unclear medical certification. This module will help you navigate the FMLA, ADA and workers compensation overlap.
  • Handling requests for reasonable accommodation.  Hot buttons – pregnancy discrimination and religious accommodation.  Practical pregnancy accommodation guidance is extracted from the United States Supreme Court’s Peggy Young v. United Parcel Services, Inc. and the EEOC Enforcement Guidance on Pregnancy Discrimination and Related Issues (June 25, 2015).  EEOC v. Abercrombie & Fitch Stores, Inc. includes 9 steps for managing an appearance code without risking a religious discrimination claim.  Understand how to employ light duty workers’ compensation, offers of suitable work, and telecommuting.
  • Avoiding hostile work place and retaliation claims.  Analyzing Flood v. Bank of America, 780 F.3d 1 (1st Cir. 2015) involving a LGBT hostile work environment discrimination claim from Maine and EEOC v. New Breed Logistics, 783 F.3d 1057 (6th Cir. 2015) and the low threshold for retaliation, we help you avoid these growing risks.
